Improved legal framework and public awareness – key to curb domestic violence

Can you give a brief about domestic violence, particularly child abuse in Vietnam?
In 2019 and 2020, Vietnam’s National Assembly conducted a supervisory programme on the implementation of policies and regulations relating to child abuse prevention and control. It was reported that between January 1, 2015, and June 30, 2019, as many as 8,442 child abuse cases involving 8,709 children were detected and cracked down. Of the child victims, 1,672 are boys and 7,037 are girls. As many as 6,431 children or 73.85 per cent of the victims were sex abuse cases. As many as 191 children were killed, 666 were injured while 106 children were reportedly smuggled and trafficked.
More than 1,300 children were victims of other types of child abuse including maltreatment, using persons under the age of 16 for child pornography; swapping children under one year old; seducing, forcing or harbouring children who violated laws or offering depraved cultural products to children.
During the period from 2015 to middle of 2019, sexual abuse against children is the most concerning issue. In some localities, child sexual abuse accounted for more than 90 per cent of total child abuse cases.
Many cases were not detected and stopped quickly, especially cases which happened in isolated remote areas, at homes of the child victims or parents of the victims knew about the abuse but did not report to authorities.
In cases, offenders made use of social networks and internet, using fake names and addresses, which caused difficulties for authorised agencies to identify, detect and punish them. Underage marriage – a custom of some ethnic groups is also a cause of child abuse cases.
In Vietnam, families believe that spare the rod, spoil the children. What do you think about such a point of view? Do you think that view an excuse for domestic violence?
I think that it is necessary to understand the saying with has a wide meaning. Whenever parents use a rod to educate their children, they should explain to the children why they do so. The children also need to understand the adults’ actions so they could aware of the care, the love and the expectations that their parents count on them. Without proper understanding, some adults use the rod all the time to punish their children when they make mistakes. It’s a crime, not a way of education which former generations’ implied.
In general, domestic violence is rooted from improper awareness on gender equality with the gender prejudice in which, boys and men are appreciated while girls and women are looked down upon. The prejudice make men bossy, they allowed themselves to abuse women while the women usually suffer the violence in silence. In many cases, the women victims are afraid that if they speak out about domestic violence, their families would be laughed at. Such thinking also leaves negative impacts on the children in such families, so they are likely to take such domestic violence for granted.
The overuse of alcoholic drinks and narcotics, improper law communication and enforcement as well as poor legal understanding are also major causes for domestic violence in Vietnam.
Nowadays, children are more vulnerable to abuse, particularly in the cyber world when they access the internet and face its negative impacts. Meanwhile, localities nationwide face the shortage of facilities for children to play, study and develop healthily and safely. In many families, parents fail to offer proper care and attention to their children because they have to struggle to make ends meet or in other cases, they rush to earn money rather than spend time taking care of their children.
What have Vietnam’s National Assembly and Government done to tackle those problems?
Vietnam has paid great attention to domestic violence prevention and control. In 1982, the country ratified the United Nations’ Convention on the Elimination of all Forms of Discrimination against Women (CEDAW). It also passed legal documents including Constitution, Criminal Code, Civil Code, Law on Marriage and Family, Law on Gender Equality to regulate issues relating to domestic violence.
On November 21, 2007, Vietnam’s National Assembly passed Law on Domestic Violence Prevention and Control to create a legal foundation to protect rights and benefits of members of the family, helping to reinforce and nurture Vietnamese homes in which every member could live and develop healthily, equally, happily and safely.
The law is also a legal tool to protect victims of domestic violence. The Government of Vietnam, ministries and agencies issued eight decrees, two resolutions, two directives, 11 decisions and 19 circulars to instruct implementing the law.
Notably, on February 6, 2014, the Prime Minister approved a national programme on domestic violence prevention and control, aiming to create milestones in improving public awareness and delivering stronger actions to curb and prevent domestic violence.
So, in terms of the legal framework, Vietnam has had a quite completed one but of course, it would still require changes to adapt to new situations. The Government reviewed the implementation of the law and planned to propose the National Assembly some amendments to the law so that relevant problems could be addressed more effectively.
How should families change their education methods to minimise domestic violence?
I think that there is no common model for education in the family. We have improved the legal framework and identified responsibilities of authorised agencies, so it’s time for families and individuals to clarify their responsibilities and obligations.
Now, people are still unclear about domestic violence and it seems that only physical abuse is noticed.
Many people believe that a slap or an angry curse to another is not wrong nor does it violate laws. If a child is naughty, parents will use rod to punish as a way of education or the wife has to satisfy the husband’s sexual needs. They don’t think such actions are domestic violence. They think the actions are as normal as meals, considering the actions are their private business that every family can have.
Even many victims themselves do not want to report the violence because they are afraid of affecting their fame and family’s honour, so they often hide it. The chain of friendship and personal dignity has obscured the legal provisions, making it not easy to enforce even though there are regulations. Without creating a good environment for laws to spread and adjust behaviour in family life, we could not effectively prevent and curb domestic violence.
Joint efforts of authorities, families, individuals and the community are needed to tackle domestic violence.
First, we need to boost communication about the law on domestic violence prevention and control, law on gender equality to improve public awareness and change people’s behaviours to domestic violence.
Second, the National Assembly and deputies continue to supervise law enforcement as well as review and amend laws to better address arising problems.
Last, it is necessary to develop a State management model in which issues of population, gender equality, family, children are combined closely. Intersectoral co-operation should be further promoted to address domestic violence. VNS/Quochoi.vn

FDI firms complain about dust from construction site of Vietnam’s Long Thanh airport project

May 1, 2023Many foreign direct investment enterprises in the Loc An – Binh Son Industrial Park, which is located near the construction site of the big-ticket Long Thanh International Airport project in Dong Nai Province, a neighbor of Ho Chi Minh City, have complained about dust resulting from the leveling of the site, saying that it has affected their products and workers’ health.
Representatives of over 200 FDI enterprises in Dong Nai on Friday attended a meeting with the provincial People’s Committee.
At the meeting, Doan Huong Giang, head of the administration and human resources division at Elite Long Thanh Co. Ltd., said “dust has caused a great impact on our products.”
“We expect the provincial authorities, departments, and agencies to come up with appropriate solutions to support Elite and other companies in preventing dust from affecting laborers’ health, product quality, and business activities,” Giang added.

Earlier, thousands of houses and a section of the Ho Chi Minh City-Long Thanh-Dau Giay Expressway near the Long Thanh International Airport project were also reported to be covered with dust from the construction site.

Do Tat Binh, deputy general director of the Airports Corporation of Vietnam (ACV), the investor of the mammoth airport project, on Friday told Tien Phong (Youth) newspaper that the corporation had asked contractors to enhance the spray of water at the construction site to limit dust.
The ACV will next week dispatch fire trucks to the site to spray water, Binh said, adding that the corporation will join forces with the local authorities to support local residents in cushioning the impact of dust.
The construction site is large and the leveling workload is huge amid the windy and dry season.
Fifty vehicles spraying water every day at the construction site is just a temporary solution and can reduce part of the dust.
“The leveling is expected to be completed by the end of May, when the rainy season will come, and the volume of dust will reduce,” Binh said.
According to the ACV, 2,630 workers along with 1,860 pieces of machinery are working to build the foundation of the airport project.
The airport project, which requires an estimated investment of VND336.63 trillion (US$14.2 billion) and is located some 40 kilometers from Ho Chi Minh City, will cover around 5,000 hectares of land and was designed to have an annual capacity of 100 million passengers and five million tons of cargo.
Once in place, it will be the largest airport in the nation.
At the conference, Nguyen Thi Kim Dung, a representative of Terumo BCT Co. Ltd. in the Long Duc Industrial Park in Long Thanh District, Dong Nai Province, also complained about the deterioration of a road connecting National Highway 51 and the industrial park.
This is a key road on which most workers of the enterprises in the area have to travel every day. However, it has been deteriorated for a long time.
The four-kilometer road has many potholes, posing a high risk of traffic accidents for road users, especially at night.
Some enterprises reported the issue to district- and province-level agencies in 2020. However, the road was repaired without care and it remains in bad conditions.
Representatives of FDI firms also mentioned the insecurity and disorder and power cuts without advance notice.
Chairman of the Dong Nai People’s Committee Cao Tien Dung said the province took responsibility for accompanying enterprises to overcome difficulties.

After the conference, the director of the provincial Department of Planning and Investment must review enterprises’ complaints and report them to the provincial authorities to work out appropriate solutions, Dung said.
Regarding the road leading to the Long Duc Industrial Park, Dung asked Long Thanh District to quickly upgrade it.
The provincial Department of Planning and Investment and the Department of Transport were assigned to ensure traffic safety for workers traveling on the road.
The Dong Nai chairman also requested the relevant agencies to review and promptly handle foreigners’ temporary residence registration and immigration applications.
Departments and agencies must review the procedure handling to meet enterprises’ demands and provide the greatest possible support for them.

Vietnam consolidates coastal dike to protect south-central airport

April 30, 2023Authorities of Phu Yen Province in south-central Vietnam have taken action to consolidate an eroded coastal dike to protect Tuy Hoa Airport.
Dang Khoa Dam, director of the management board of construction investment projects of Phu Yen, said on Saturday that his unit started building a sea embankment to protect Hung Vuong Street, which connects the eastern end of the seaside Tuy Hoa Airport with the province’s eponymous capital city.
The embankment will stretch 885 meters to prevent sea waves and high tides from rubbing the road.
The cost of the project is approximately VND150 billion (US$6.4 million).
Dam’s unit will strive to complete the new dike section before this year’s rainy season although its deadline is 2024.
“The erosion is so serious that unless we do it urgently and quickly, the consequences will be unpredictable when the stormy season comes,” said Dam.
Built about ten years ago to link Tuy Hoa City with Tuy Hoa Airport, which are some 11 kilometers apart, Hung Vuong Street is made of cement concrete, not asphalt concrete, as the authorities had foreseen coastal erosion.
Despite that, strong waves under the impact of climate change have washed away hundreds of meters of sand along the road over the years.
In 2019, the management board of construction investment projects of Phu Yen dumped thoursands of cubic meters of rocks along the road to fortify a 600-meter-long embankment that was damaged by waves.
In the past two years, sea waves have continued to erode Hung Vuong Street, washing away the roadbed’s sand layer, putting the road on the verge of collapse, and posing a direct threat to the safety of Tuy Hoa Airport.

Waste burning poses risk of forest fires in Ho Chi Minh City

April 30, 2023Many people have been burning garbage and scrap along streets and near forests in Binh Chanh District, Ho Chi Minh City, posing a very high risk of wildfires.
An area close to forests in Binh Chanh District became a popular place for people to secretly burn scrap at midnight and dawn, according to the observation of Tien Phong (Youth) newspaper reporters in late March.

These groups of people burned scrap on both sides of Hai Phung Bridge, located at the border area between Pham Van Hai Commune and Vinh Loc B Commune, in order to get metals such as copper and iron.
Columns of smoke produced by the scrap burning flew toward the forests. Meanwhile, many trees at the foot of the bridge have withered.

Kenh Lien Vung Street in Vinh Loc B Commune, Binh Chanh District has also become a popular place for garbage and scrap burning.
“There are few houses on the road, so many people burn garbage to avoid getting caught,” a local resident said.
“There is a lot of smoke, and the smell of burning plastic is very unpleasant.”
